These Terms and Conditions (“Terms”) govern your use of our website https://risingsunwatersports.com and any services provided by Rising Sun Watersports, including pontoon boat rentals in Florida. By accessing or using our site and services, you agree to comply with and be bound by these Terms.
Rising Sun Watersports LLC – We rent pontoon boats, paddle boards and other water accessories.
By using our services and providing your phone number, you agree to receive text messages from us as described in these terms.
If you do not agree to these Terms, please do not use our services.
1. Eligibility
You must be at least 21 years old to rent a pontoon boat from us and possess a valid government-issued photo ID and a valid boating license (if required under Florida law). Renters must also meet all applicable insurance and safety requirements.
2. Booking & Payment
All rentals must be reserved online through our website or by phone.
Full payment is required at the time of booking.
We accept major credit cards and other secure payment methods provided on the website.
A security deposit may be required and will be refunded after inspection of the vessel, subject to damage or policy violations.
3. Cancellations & Refund Policy
Cancellations made more than 72 hours before your rental are eligible for a full refund.
Cancellations within 72 hours of the rental date are non-refundable.
Weather-related cancellations, as determined by Rising Sun Watersports (e.g., unsafe boating conditions), will be refunded or rescheduled at no charge.
4. Safety & Responsibility
Renters must operate the pontoon in a safe and lawful manner at all times.
Consumption of alcohol by the operator is strictly prohibited.
Life jackets must be worn by children under 6 and available for all passengers.
Any damage to the boat or equipment during the rental period is the sole responsibility of the renter.
We reserve the right to refuse service to anyone under the influence of drugs or alcohol or who presents a safety risk.
5. Assumption of Risk & Release of Liability
By renting a pontoon from Rising Sun Watersports, you understand and agree that:
Boating involves inherent risks, including injury or death.
You voluntarily assume all risks associated with your rental.
You release and hold harmless Rising Sun Watersports, its owners, employees, and affiliates from any liability for injury, death, loss, or damage to person or property arising out of your use of our vessels.
6. Prohibited Activities
You agree not to:
Operate the vessel under the influence of drugs or alcohol.
Exceed the passenger or weight limit posted on the vessel.
Take the boat into unauthorized waters or restricted areas.
Use the vessel for any illegal or commercial purpose.
7. Indemnification
You agree to indemnify and hold Rising Sun Watersports harmless from any claims, damages, or losses, including legal fees, arising from your use of the vessel, your breach of these Terms, or any injury or damage you cause to third parties.
8. Website Use
By using our website, you agree not to:
Attempt to access protected areas without authorization.
Scrape, crawl, or collect data without our written permission.
Upload malicious code or interfere with the website’s operation.
You can cancel the SMS service at any time. Just text “STOP” to 850-699-3974. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. Carriers are not liable for delayed or undelivered messages.

Restrictions
- Operators will provide safety training on-site for the use of any motorized water vessel. If the operator determines, in its sole discretion, that a guest is unable to understand the training it provides, is unable to read and understand waterway signage, is impaired, or is a threat to their own safety or the safety of others, operation of the vessel may be denied and a full refund will be issued. TripShock has no authority or discretion to determine whether or not a guest may operate a motorized water vessel.
- A link to a boater’s safety test will be included in your voucher and is required for obtaining a Temporary Florida Boater’s License. Adults born BEFORE January 1, 1988, may operate a boat or personal watercraft with a valid driver’s license. However, drivers born on or after January 1, 1988, must take the test and obtain a Temporary Florida Boater’s License. In the interest of safety, it is recommended that all drivers take the test and obtain the license.
- When booking, there will be a $500 hold on credit card if the damage protection is declined; however, if damage protection is purchased, no deposit is required.
- If you do not bring the boat back within the time frame designated, a $100/hour charge will be applied and payable directly to the vendor.
- The person signing the contract must be 21 years old or older, have a valid picture ID, & a VALID credit card for incidentals.
- Half-day bookings must depart and arrive on time as there are other bookings using the same boat on the same day.
- No alcohol may be consumed while operating a vessel of any kind on Florida’s waterways.
- Due to parking constraints, there is a limit of 2 vehicles per party.
- Pontoon boats are prohibited from entering the Gulf of Mexico.
- Pontoon boats can hold a maximum of 11 people or 1700 lbs.
- Boats cannot be used as a shuttle.
Additional Information
- If weather is deemed by the vendor as unfavorable for this activity, your reservation may be altered, modified, rescheduled, or refunded at vendor discretion.
- Boats have compartments to hold small valuables such as wallets, watches, and jewelry. However, it is best to leave all these items back home or in your vehicle.
- You will be cruising on 2016 or newer 24ft Bentley Pontoons with premium sound systems, USB power outlets and 50HP engines.
- If there is rain while you are on the boat and you are called back to dock early, the purchase price will be prorated accordingly.
- Free parking is available on-site.
- Pets and service dogs allowed.
- Gratuities are not included.
- Handicap accessible.
